Abstract

The article presents the review of the conception of discretion and police discretionary power. The author views the subject of discretionary power and the control system of discretion as the central problem of police law.
Secondly, since police discretion is inevitable, the true policy choice is not between rules and discretion, but between different rules and different degrees of discretion.
The author does not convincingly answer this question, because he hopes, that knowledge of the difficulties of reforming the police law system helps to avoid future acceptance of overly – simplistic solutions of the policing discretion problems.
