The Knowledge of an Average Person and the Special Knowledge

Abstract
The range of the notion „special knowledge“ is of paramount importance for the expert appraisal. Polish literature is dominated by the view that this is the information exceeding the knowledge and life experience of an average person. The judicial practice (concerning trafic accidents and documents) shows that the offices of the system of justice too often nominate experts, which denotes that particular issues are unnecessarily qualified as requiring special knowledge. The paper presents results of research and examples confirming such an opinion. Such practice results in overburdening the experts with unnecessary work and extends the evidence procedures.
