Abstract

The authors of the article seek for broader and deeper definition of legal custom. The article explores definition of legal custom, it features and differencies from other instruments of normative regulation, including non legal custom and state created law. The authors draw attention to the role of legal custom, which is usually accepted by positivist legal theories, and which can be actually observed. The article explores the role of legal custom in legal systems of Common law and Continental law, including Lithuania. The article also analyses positive and negative aspects of customary law.
