Default Judgement in Foreign Civil Process Laws: Importance, Passing Conditions and Appeal

Abstract
Im Aufsatz beschäftigt sich der Autor mit dem Versäumnisurteil. Verschiedene Fragen sind erwähnt: die Verzögerung des Prozesses durch die nicht erschienene Partei; der Erlass des Urteils als Folge der Versäumung; die Bedeutung des Versäumnisurteils; die Voraussetzungen und Anfechtung. Zu betonen ist, dass ein neues Institut in das litauische Rechtssystem eingeführt werden muss – das Urteil als Folge der Versäumung (Versäumnisurteil). Die Arbeitsgruppe der neuen litauischen Zivilprozessordnung und der Gesetzgeber sollen die führende Praxis der ausländischen Staaten und die Rechtstraditionen der Litauen in der Zeit zwischen zwei Weltkriegen (1918–1940) beachten.
