Abstract

The article „Lithuanian laws, regulating right to work for people with disabilities, their conformity to international norms and standards“ sets an aim to analyze Lithuanian legislation, regulating the right to work and occupation of people with disabilities, and to present conclusions on it‘s conformity to international standards and accredited norms.
Following the objectives set the article presents Lithuanian situation in the field of disabled people work, statistical data on their unemployment in comparison to the trends of general state unemployment rate. It introduces in different aspects new official statistics on the disability, vocational training and employment, occupation of people with disabilities. Assessment of possibilities for the disabled people to realize their right to work and occupation, assumptions and opportunities for realization of this right in Lithuanian society is presented.
Main provisions and principles for an equal right to work, equal work conditions and pay for the work, vocational training and rehabilitation, etc. of people with disabilities, specified both in the global (United Nations Organization and its established specialized agency International Labor Organization) and regional international legal acts are discussed. The article also presents an analysis of Lithuanian legal acts that are in force and new draft laws, indicating main provisions of implementing right to work for the disabled people. It describes trends of national legal base developments and perspectives in the sphere of the disabled people rights' security and protection. Taking into consideration international standards and principles, the analysis of conformity of Lithuanian national legal base guarantying right to work and equal opportunities to participate in the open labor market for people with disabilities with mentioned international norms is produced.
Official statistical data and indexes, Lithuanian and foreign scientific and methodical literature, various national and international normative acts, regulating legal status, security guaranties of rights and interest of people with disabilities are introduced, comparative analysis and assessment of materials used.
The article presents conclusions on the Lithuanian laws and their conformity to the international standards and principles on the equal rights to work and occupation for people with disabilities. It provides that most of the international standards are transposed into the laws of the Republic of Lithuania. Lithuanian legislation provides with the fundamental rights to work, to secure working place, fair pay for the work and guarantee social security in cases of unemployment for all persons (including the disabled), besides it foresee additional occupation guarantees for people with disabilities. But in most of cases law provisions are of declarative nature, difficult to implement and therefore not effective, since only few of them are secured by the concrete state financed means and programs. Therefore, concluding on the present working situation with regards to people with disabilities, it may be stated that most of the disabled people in Lithuania are still not able to use and realize their right to work and occupation on equal grounds with other people.
