Abstract

The article investigates some aspects of the appliance of the suspended sentence for drug-addicted offenders in Lithuania. This kind of sentence is often applied to the drug-addicted offenders. But the success of this measure strongly depends on the right estimate of the offender’s personality and social surrounding. So the questions are: what are the criteria for the courts in making such sentences? And are the courts capable to estimate the personality and social situation of a drug-addicted offender? The explored cases show the lack of legal criteria in this area. The author also proposes to set the legal criteria of the obligatory medical treatment of drug-abuse, so it would be possible to see, whether the obligation is executed, or not. Some other points are proposed to state the suspended sentence as an effective measure for the drug-addicted offenders in preventing crime.
