Abstract

The model of conjugality and family as the union between to persons – a man and a woman in the post-modern society every time experience more intense and crucial modifications. In the 20th century conjugality lost one of its traits that till then seemed to be inherent – permanence and longevity. So called divorce revolution determined that matrimony became a “serial” event in the life of individual as well as the fact that the number of children growing-up with only one of the parents raised considerably. This conditioned responsive appearances – a person who has been raised not in a full family himself is more susceptible to divorce as well as to choose numerous alternative forms of common life instead of conjugality. This way conjugality becomes not unique or at least principal way to organise one‘s family life and is necessitated to exist upstaged by various modes of cohabitation. The further modifications of conjugality and family concept has gone far denying the absolute of conjugality and family that is understood exclusively as the relation between persons of different sex – a man and a woman. This is regarding the legalisation of conjugality between same sex persons. In the context of artificial impregnation the concept of conjugality and family as the relation between two persons is starting to be put under debate and the proposals to legally introduce several forms of group conjugality is raised more and more actively. Artificial impregnation as such is dealt as well with the new concept of psychological parenthood that in contemporary society co-exists together with the biological one, often gaining priority over the latter or completely devaluating its importance.
Evaluating the impact such transformations have on the children’s rights and interests, authors of the current article claim that the essence of this impact is the total ignorance of principal children’s rights such as right to have, to know and to be raised by both parents. Answering the question what encourages the changes of family and conjugality concept, it should be sadly stated that often it is the rights of adults or, moreover, their whims not corresponding with any duties towards children. The rights and interests of children are often not paid attention on or simply neglected.
