Abstract

Straipsnyje analizuojamos teisinio reguliavimo, nustatančio viešojo intereso gynimą planuojant teritorijas, problemos. Identifikuojami subjektai, turintys teisę ginti viešąjį interesą planuojant teritorijas, apibrėžiamos tų subjektų kompetencijos ribos. Straipsnyje nemažai dėmesio skiriama suinteresuotos visuomenės teisių viešojo intereso gynimui nagrinėti. Europos Sąjungos Teisingumo Teismo ir Lietuvos vyriausiojo administracinio teismo jurisprudencijos analizės pagrindu yra vertinama, ar nacionalinėje teisėje įtvirtintas teisinis reguliavimas, suteikiantis teisę suinteresuotai visuomenei ginti viešąjį interesą, atitinka Orhuso konvencijoje suformuluotus tikslus.
