Abstract

The idea to implement the function of public order protection through municipalities is new in Lithuania. There is no scientific and practical literature on this issue. Thus the author bases his ideas on the experience and practice of foreign scientists and practitioners.
The foreign scientists analyzed discuss many models of the municipal public order protection services (the municipal police). The fundamental idea is that the municipal public order protection services, as the law enforcement services, must be under responsibility of municipalities.
The municipalities must have the right of initiative to create such services. These services must be fully financed by the municipalities. The cooperation between the police and the municipal public order protection services must be based on competence dissociation, cooperation and mutual respect principles.
Usually the creation of municipal public order protection services depends on economical and political conditions and the development of local government of the country.
The main object of this article is to analyze the type, the sort of the tasks and the functions that could be implemented by the newly created municipal public order protection services in Lithuania.
The author made a few conclusions after the analysis of the topic. The public order protection is one of the main tasks or functions of the municipal public order protection services. It means that the municipal public order protection services could focus their activities on maintaining safety of the community, protection of life, health, honor and dignity of the people, protection of the rights and freedoms of the community, and saving the national interests from unlawful infirngements in public.
The “non criminal” tasks and functions are also analyzed in the article. Such functions could include social assistance and other helpful activities for local residents, which are not implemented by other institutions or organizations in Lithuania. Nowadays the social support task is a part of the competence of the police, but this task is not an organic police task, so it has be delegated to the competence of the municipal public order protection services for the purposes of efficient implementation.
The last group of tasks and functions that must be delegated to municipal public order protection services comprises of control and supervision of the municipal legal acts’ implementation.
